In a significant escalation of the ongoing dispute over industrialist Sunjay Kapur’s estate, his children from his marriage to actor Karisma Kapoor—Samaira and Kiaan—have urged the court to initiate criminal proceedings against Priya Kapur, their father’s second wife. Sources informed that the siblings are seeking to invoke Sections 338 and 340 of the Bharatiya Nyaya Samhita against Priya, alleging that she fabricated a will that entirely excludes them from their inheritance. Should the allegations lead to a conviction, Priya could face life imprisonment.
What began as a civil partition suit in the Delhi High Court now risks transforming into a criminal matter due to these fresh demands. The siblings have highlighted several inconsistencies in the “digital trail” of the will presented by Priya Kapur in court.
According to Priya’s submissions, the document was initially drafted on February 10, 2025, revised on March 17, and formally executed on March 21 in the presence of two attesting witnesses—Dinesh Aggarwal and Nitin Sharma—at the Gurgaon office of AIPL. However, Samaira and Kiaan contend that Sunjay Kapur and Priya were not in Gurgaon on March 21. Instead, they were in Delhi, where Sunjay was communicating with Karisma Kapoor via WhatsApp about Portuguese citizenship applications for the children.
The siblings further assert that Sunjay was vacationing with Kiaan in Goa on March 17 and returned to Delhi that evening to visit his mother, Rani Kapur, following her fall—contradicting the claimed modification date. They argue that the statements from the attesting witnesses fail to confirm the execution occurred in Gurgaon, strengthening their claim of forgery.

A key focus is the absence of any digital footprint from Sunjay Kapur himself in the presented trail. Sources indicate that Priya’s account leaves unclear who prepared the initial draft. The earliest records appear as screenshots from Nitin Sharma’s device, later transferred via email to Dinesh Aggarwal, and then shared in a WhatsApp group involving Sunjay, Priya, and Aggarwal on March 24—three days after the alleged execution—with no active participation from Sunjay’s known number.
The children have requested the court to seize the mobile phones of Priya Kapur, Sunjay Kapur (posthumously), Dinesh Aggarwal, and Nitin Sharma to investigate the purported fake digital trail. They also point to discrepancies in the executor’s role: Shraddha Suri Marwah, described as a close friend of Sunjay, reportedly inquired about the drafter in June emails without receiving clarity. Court proceedings later revealed Nitin Sharma—not a lawyer—drafted the document, though he has yet to testify on this.
Additional issues include spelling and grammatical errors in the will—such as “Master Azarias” rendered as “Master Azrias” and referring to a male testator as “her”—which the siblings say an educated man like their father would not have made. They also note the document incorrectly identifies Safira Chatwal as Sunjay’s daughter.
The matter is scheduled for further proceedings on January 20 before Judicial Magistrate Gagandeep Singh. This development adds a criminal dimension to a high-stakes family feud that has gripped public attention since Sunjay Kapur’s death in June 2025.
