A Goa court on Wednesday granted conditional bail to businessmen Gaurav Luthra and Saurabh Luthra in the nightclub fire case that claimed 25 lives in December 2025 but the brothers will not be walking free anytime soon.
The relief is partial at best. While the court granted them bail on charges of negligence and culpable homicide related to the deadly blaze at Birch by Romeo Lane nightclub in North Goa, the Luthra brothers remain in judicial custody owing to a separate and ongoing forgery case tied to the same incident.
Bail Granted, Freedom Denied
The bail in the fire case comes at a stage where legal experts say custodial interrogation is typically no longer deemed essential once a chargesheet has been filed and the investigation has advanced significantly. The court is also reported to have attached conditions to the bail, including a bar on travel and a requirement to cooperate with the continuing probe.
However, those conditions are largely academic for now. The parallel forgery case in which the brothers were earlier denied anticipatory bail keeps them firmly behind bars.
Fake NOCs at the Heart of the Fraud Probe
Authorities allege that forged or manipulated No Objection Certificates may have been used to obtain the licences and permissions needed to run the upscale North Goa nightclub. Investigators have been examining whether these alleged document irregularities enabled the club to operate despite potential safety gaps.
The December 2025 fire at Birch by Romeo Lane had sent shockwaves across the country. Post-incident investigations flagged multiple alleged violations at the venue, including inadequate fire safety provisions and overcrowding factors believed to have contributed to the scale of the tragedy.
A Long Road Ahead for Victims’ Families
The dual proceedings one probing criminal negligence, the other alleged regulatory fraud reflect the complexity of a case that spans both human tragedy and institutional failure. For the families of the 25 victims, the legal battle is far from over, with several charges and cases still to be argued and adjudicated in court.
