Delhi High Court : Court Questions Priya Kapur’s Plea To Disclose Sunjay Kapur Assets In Sealed Cover

New Delhi : The Delhi High Court, on Thursday, adjourned until tomorrow a petition filed by late businessman Sanjay Kapur’s wife, Priya Kapur, who has sought permission to file a list of his personal assets and liabilities in a sealed cover. Senior advocate Shyel Trehan, representing Priya Kapur, argued that the details of the assets include sensitive financial information, the disclosure of which in the public domain could cause irreparable harm.
The plea requested that the documents be filed under confidentiality obligations or, alternatively, that a Confidentiality Club be constituted to limit access. I am willing to show it to all parties, but request it be held as confidential, Trehan said. The court, however, raised questions on Kapur’s request, noting that opposing parties required access to details to respond adequately. The whole suit cannot be in a sealed cover, the bench observed, while inviting suggestions to balance confidentiality with the rights of all parties.
The court added that it is wondering what would happen when Priya Kapur files her written statements, since at the end of the day the will, will have to be included in it. The court also asked Priya’s counsel to address the issue of NDA also remarking that ‘its a little unusual in a partition suit. It may be problematic for the simple reason that as the alleged beneficiary of the estate, they (Karisma Kapoor’s children) have a right to question the assets disclosed.
The counsel representing Karisma Kapoor’s children argued that details regarding the property should largely remain public. They also alleged that, per their information, “banks have been wiped off”, leaving nothing in the account. Senior advocate Amit Sibal, representing Sunjay Kapur’s mother and a class 1 heir, stressed that he must have full access to the asset details to independently verify the will.
The proceedings highlight the delicate balance between privacy in high-profile inheritance matters and the legal rights of heirs to access and scrutinise details of assets. The next hearing is expected to determine the extent to which confidentiality can be accommodated in the case.
