Mumbai: The Municipal Corporation of Greater Mumbai (MCGM) took action against illegal construction and alterations carried out in violation of the sanctioned plan and Floor Space Index (FSI) norms at a building on Gokhale Road in Prabhadevi.
Action was taken against illegal construction at the Rustomjee Crown building in Prabhadevi over two consecutive days, on Tuesday, August 24, and Wednesday, August 25, during which unauthorised construction and unapproved alterations in a total of nine flats were demolished.
Building has 63 floors including three basements
According to a civic official, Rustomjee Crown has 63 floors, including three basements plus the ground floor. The first 12 floors of the building are for parking, the 10th and 11th floors are for a fitness centre, the 13th floor is a service floor, while floors 14 to 63 are for residential use. The residential area comprises three wings — A, B and C. Wings A and C have received Occupancy Certificates (OC) and together contain 186 flats.
138 notices issued under MMC Act and MRTP Act
Based on complaints received regarding FSI violations and unauthorised construction and alterations in the building, a total of 138 notices were issued to the concerned flats in Wings A and C under the relevant provisions of the Mumbai Municipal Corporation Act, 1888, and the Maharashtra Regional and Town Planning Act, 1966 (MRTP Act).
After the legal process was completed and notices of action were served, those concerned were given the opportunity to submit their statements, documents and explanations, and to be heard. After considering the documents, statements and available records submitted by the concerned parties, speaking orders were passed in the applicable cases. Following this, action was taken against unauthorised construction and alterations in the flats on August 24 and 25. This action was carried out by civic staff and the appointed eviction contractor after completing the prescribed legal process.

Illegal enclosures found using Siporex bricks, wood and MS plates
During the inspection, it was found that in some flats, a portion of the common lobby had been illegally enclosed using wooden materials and lightweight Siporex bricks, with this portion incorporated into the flat’s habitable area. Additionally, a portion of the kitchen duct had been illegally enclosed using an MS plate and incorporated into the kitchen area. Furthermore, a portion of a room had been illegally incorporated into the kitchen area using Siporex material. All these unauthorised constructions and alterations were removed in accordance with the relevant notices and speaking orders.
15 workers, 8 police personnel deployed for eviction drive
The Municipal Corporation deployed 15 workers, two mukadams (supervisors), four engineers and eight police personnel for the eviction action. Action against unauthorised construction and internal alterations was thus completed in a total of nine flats in the building. The administration has clarified that further action in the remaining eligible cases will continue by applying the prescribed legal process.
