Gurugram: The arrest of Kalyan Bainsla in connection with the alleged hit and run involving biker Shivani Chauhan, popularly known as Sia, has not ended the controversy. Sia says she wants the investigation to continue and action to be taken against everyone found responsible.
Bainsla was arrested in Rajasthan on September 15, while his cousin Lavnish Bainsla was also detained in connection with the case. Police have added Section 109 of the Bharatiya Nyaya Sanhita (BNS), which deals with attempt to murder, to the case.
The incident took place on Golf Course Road in Gurugram and was captured on camera. The footage later spread widely on social media.
What happened?
Sia has alleged that a white Maruti Suzuki Ciaz hit her motorcycle deliberately after the occupants of the car allegedly made inappropriate comments towards her.
She was riding an Aprilia RS 457 at the time. She fell on the road after the collision and later underwent a medical examination.
Sia has said she believes the crash could have caused much more serious consequences and has questioned why only two people have been arrested if others were also inside the car.
Police are examining CCTV footage, camera recordings, witness statements and other evidence as part of the investigation.
Defence disputes Sia’s account
Bainsla’s lawyer has rejected the allegation that the collision was deliberate. The defence has claimed that the bikers were riding recklessly and that Bainsla left the scene because he feared being attacked by people who had gathered there.
The defence’s version conflicts with Sia’s allegation that the car was intentionally driven towards her. The exact circumstances of the crash will be determined through the investigation and court proceedings.
Police trace accused to Rajasthan
According to police, video footage helped investigators identify Bainsla, who was subsequently traced to Rajasthan.
Police have also been investigating allegations that inappropriate remarks were made before the crash and the possible involvement of other people who were travelling in the car.
There was another development after Bainsla’s arrest, with police reportedly saying he attempted to escape during custody and was injured after falling.
Sia rejects publicity claims
Sia has also rejected claims that she was using the incident to gain publicity. She pointed out that she had previously contested the 2022 MCD election as an AAP candidate.
For now, the investigation remains underway. The police will have to establish what happened immediately before the collision, who was responsible and what role, if any, each person in the vehicle played.
Sia, meanwhile, has made her position clear she says an arrest is only the beginning and wants the case to be taken to its legal conclusion.
