Prescription Now Required for All Medicinal Syrups as Sales rules Changes

In a significant regulatory shift aimed at enhancing oversight of pharmaceutical sales, the central government has made a doctor’s prescription mandatory for purchasing all syrup-based medicines, including popular cough syrups. This change eliminates their previous availability as over-the-counter products.

The update stems from a notification issued by the Union Ministry of Health and Family Welfare on June 9, which introduced the Drugs (Fifth Amendment) Rules, 2026. These rules amend the existing Drugs Rules, 1945, by removing the term “Syrups” from a specific category in Schedule K. As a result, such formulations can no longer be sold without medical authorization.

Under the revised provisions, exercised through powers outlined in Sections 12 and 33 of the Drugs and Cosmetics Act, 1940, the amendment officially took effect upon its publication in the Official Gazette. The specific change targets item number seven under the “Class of Drugs” heading in Schedule K, where the reference to syrups has been deleted.

This development directly impacts consumers who have long relied on easy access to cough and other medicinal syrups at pharmacies. Individuals will now need to consult a registered medical practitioner and obtain a valid prescription before making such purchases. The policy is likely to alter everyday buying habits for these commonly used remedies.

Prior to finalization, draft versions of the rules were made public on December 30, 2025, allowing for public objections and suggestions. Authorities reviewed all feedback received during this period before proceeding with the amendment. The official notification was signed by Harsh Mangla, Joint Secretary in the Department of Health and Family Welfare.

Pharmacies nationwide are now required to adhere to the updated guidelines when dispensing syrups and related medicinal products. The measure reflects a broader effort to regulate the distribution of these medicines more stringently, ensuring they are dispensed only under professional medical guidance.
